These Terms of Service explain the rules for using I Need An Arborist. By using this website, creating an account, submitting a listing, or contacting a listed professional through information found on this website, you agree to these Terms.
1. What This Website Does
I Need An Arborist is a search and listing platform for tree-related services. The website helps users search for listed tree professionals, tree care companies, consultants, foresters, plant health care providers, emergency tree service providers, and related professionals based on location, services offered, and information provided by listed professionals.
I Need An Arborist does not provide referrals, recommendations, or professional advice. Search results and listed professional displays are based on information provided by listed professionals and search criteria provided by users. Inclusion in search results does not constitute a referral, recommendation, endorsement, or guarantee.
I Need An Arborist is not a referral service, broker, hiring agency, marketplace, tree care company, contractor, employer, insurer, credentialing body, licensing agency, or professional association.
2. Users and Members
A user is a person who uses the website to search for tree-related help.
A member is a professional, company, or organization that creates an account or paid listing on the website.
Public-facing pages may refer to members as listed professionals, tree professionals, companies, consultants, or providers.
3. Listed Professionals Are Independent
Listed professionals are independent from I Need An Arborist. I Need An Arborist does not employ, supervise, control, insure, manage, or direct the work of any listed professional.
Any agreement for services is solely between the user and the professional or company the user chooses to contact or hire.
I Need An Arborist is not a party to, and has no obligation regarding, any agreement, transaction, estimate, contract, communication, dispute, payment, or service issue between a user and a listed professional.
4. Self-Reported Information
Information shown in listings may include services, credentials, licenses, memberships, insurance, bonding, business qualifications, equipment, availability, service areas, and other capabilities.
This information is self-reported by listed professionals.
I Need An Arborist does not collect, review, store, verify, or maintain credential documents, insurance certificates, Certificates of Insurance, bonds, licenses, workers’ compensation documents, or other supporting documentation.
Insurance, bonding, license, credential, and capability information is entirely self-reported by the listed professional. I Need An Arborist does not collect, review, track, or maintain active policy periods, coverage limits, exclusions, license status, or renewal status.
5. User Responsibility
Users are responsible for deciding whom to contact or hire.
Before hiring any listed professional, users should independently verify all relevant information, including credentials, licenses, insurance coverage, workers’ compensation coverage, bonding, qualifications, availability, service scope, and suitability for the specific work needed.
Users should request current proof directly from the professional, issuing organization, licensing agency, insurance provider, or other appropriate source. For tree work, users should consider requesting a current Certificate of Insurance directly from the professional or insurance provider before work begins.
Users should also consider obtaining and reviewing written estimates, written contracts, project scope, payment terms, proof of insurance, and any required licenses before authorizing work.
6. No Verification, Guarantee, or Endorsement
I Need An Arborist does not verify, approve, vet, guarantee, recommend, refer, or endorse any listed professional.
I Need An Arborist does not guarantee, and makes no representations regarding, the accuracy, completeness, or current status of any information provided by listed professionals, including but not limited to credentials, licenses, insurance coverage, bonding, qualifications, services, equipment, capabilities, workmanship, safety practices, availability, suitability, or the outcome of any services performed.
7. No Affiliation With Credentialing or Licensing Organizations
I Need An Arborist is an independent platform.
Organization names, credential names, certification names, designations, and trademarks are used for identification and informational purposes only. Their use does not imply affiliation, endorsement, sponsorship, partnership, approval, or verification by those organizations.
This includes, but is not limited to, organizations such as the International Society of Arboriculture (ISA), American Society of Consulting Arborists (ASCA), Tree Care Industry Association (TCIA), Society of American Foresters (SAF), Association of Consulting Foresters (ACF), Arboricultural Association, European Arboricultural Council (EAC), Independent Arboricultural Consultants Association (IACA), New Zealand Arboricultural Association (NZ Arb), and any state, provincial, national, or international licensing or credentialing body.
Inclusion of any credential, certification, license, membership, or professional designation in this system does not constitute a recommendation or endorsement of that credential by I Need An Arborist, nor does it imply that credentials not listed are less valid.
8. Member Listings
Members are responsible for providing accurate, current, and lawful listing information.
Members may not claim credentials, licenses, memberships, insurance, bonding, services, equipment, or capabilities they do not hold or offer.
Members are responsible for updating their listing if their information changes.
I Need An Arborist may remove, hide, suspend, decline, or terminate any listing or account at its discretion, including listings that appear inaccurate, misleading, incomplete, inactive, unlawful, or inconsistent with the purpose of the website.
Removal, suspension, hiding, or termination of a listing does not automatically entitle the member to a refund. Refund availability, if any, is addressed in the payment, cancellation, and refund section of these Terms.
9. Paid Memberships, Cancellation, and Refunds
Payment for a membership or listing gives a member access to create or maintain a listing, subject to these Terms.
A listing fee is not a guarantee of calls, leads, users, views, ranking, revenue, placement, endorsement, recommendation, or any specific business result.
Listing fees are charged on an annual basis unless otherwise stated at the time of purchase.
At launch, listings do not automatically renew. I Need An Arborist may send a renewal notice before a listing period expires. If a member does not renew, the listing may expire, be hidden, or become inactive.
Listing fees are generally final and non-refundable once paid, except where required by applicable law.
If a member’s listing is removed, hidden, suspended, or terminated because the member violated these Terms, provided false or misleading information, misused the website, or failed to maintain accurate listing information, no refund is owed.
I Need An Arborist may offer a refund, credit, or other adjustment at its discretion if I Need An Arborist is unable to provide the listing service for reasons unrelated to the member’s conduct.
If consumer protection laws in a member’s jurisdiction provide cancellation or refund rights that exceed this policy, those rights apply.
Payment processing may be handled by third-party payment providers. I Need An Arborist may change payment providers or payment methods over time.
Some memberships are provided through company-sponsored seats rather than direct individual payment. A company may invite an individual professional to accept one of its available seats. A pending invitation may expire or be withdrawn before acceptance, and an invitation alone does not change the individual’s existing membership, seat, or company affiliation.
An individual may hold only one active company-sponsored seat at a time. If an individual who already has an active company seat accepts another company’s invitation and explicitly confirms the transfer, the former seat ends and the destination seat becomes active.
While a company-sponsored seat is active, the sponsoring company affiliation is displayed on the individual’s public profile and cannot be hidden. An individual who does not agree to that public affiliation should not accept the seat. The company may revoke an active seat, the individual may voluntarily leave it, and the seat may also end if the company’s membership expires or the individual confirms a transfer to another company.
If the individual has unused paid individual-membership time when company sponsorship begins, the remaining time is preserved while the company seat is active and may resume when sponsorship ends. The beginning, transfer, or ending of a company-sponsored seat does not, by itself, create a refund entitlement beyond the refund rights otherwise stated in these Terms or required by applicable law.
I Need An Arborist may retain private seat, invitation, membership, affiliation, notification, payment, and lifecycle records when reasonably necessary for membership administration, accounting, security, fraud or abuse prevention, dispute resolution, enforcement of agreements, system reconciliation, legal compliance, and business recordkeeping.
Member Referral Program
I Need An Arborist is not a consumer-to-arborist referral service, broker, marketplace, or hiring agency. Separately, the Member Referral Program is a membership-reward program through which an eligible member may receive membership credit for referring a new member whose first qualifying paid membership satisfies the applicable qualification period and program requirements.
Referral rewards are membership credit, not cash, and self-referrals are not permitted. The reward may depend on the referred account’s first qualifying paid Professional membership or Business plan. A later upgrade does not create an additional referral reward, and a complimentary or $0 membership does not qualify.
Business affiliation, a seat invitation, seat acceptance, or other seat activity does not by itself generate a referral reward. Refunds, chargebacks, fraud, abuse, duplicate or self-controlled accounts, or other disqualification may prevent or reverse appropriate membership credit as allowed by the program. Program mechanics may also be subject to applicable program terms.
10. Direct Contact Model
I Need An Arborist is intended to help users find and contact listed professionals directly.
I Need An Arborist does not sell public users’ contact information as shared leads to multiple companies.
If this model changes in the future, the Terms of Service and Privacy Policy will be updated before the change takes effect.
11. Member-Submitted Listing Content
Members may submit listing information such as business names, profile text, logos, photographs, service descriptions, credentials, licenses, contact information, and other content.
By submitting listing content, members grant I Need An Arborist a non-exclusive, royalty-free, worldwide license to display, reproduce, format, and distribute that content as part of operating the website, displaying listings, and providing search results to users.
This license continues for as long as the listing is active. After a listing expires, is removed, or becomes inactive, I Need An Arborist may retain cached, archived, or recordkeeping copies for a reasonable period for technical, legal, security, recordkeeping, or operational reasons.
I Need An Arborist will not use member listing content for unrelated commercial purposes without permission.
Members confirm that they have the right to submit the content they provide and that their listing content does not infringe the rights of another person, company, organization, or third party.
12. If Listing Information Is Wrong
Members are responsible for the information in their listings.
If a claim, dispute, complaint, demand, lawsuit, liability, cost, or expense arises because of information a member provided, including credentials, licenses, insurance, services, capabilities, or qualifications that were inaccurate, false, misleading, unlawful, or outdated, the member agrees to defend and hold harmless I Need An Arborist from that claim to the fullest extent permitted by law.
This also applies to claims, disputes, or legal actions arising from the member’s actual services, failure to perform services, communications with users, estimates, contracts, payments, workmanship, safety practices, or business conduct.
In plain terms: members are responsible for their listings, their claims, their work, and their business conduct.
13. Prohibited Use
Users and members may not use the website to:
- Submit false, misleading, outdated, or unlawful information.
- Claim credentials, licenses, insurance, bonding, or qualifications they do not hold.
- Scrape, copy, harvest, or misuse listing data.
- Use listing information to contact listed professionals for spam, unrelated solicitation, advertising, or sales unrelated to tree care.
- Interfere with website security or functionality.
- Impersonate another person, company, organization, or agency.
- Use the website for spam, fraud, harassment, or unlawful activity.
- Post false reviews, fabricated testimonials, or misleading endorsements if reviews or testimonials are later added.
- Misrepresent any relationship with I Need An Arborist.
14. Third-Party Links
The website may link to third-party websites, including professional organizations, credentialing bodies, licensing agencies, payment processors, and member websites.
These links are provided for convenience and informational purposes only. I Need An Arborist does not control third-party websites and does not guarantee that third-party information is complete, current, accurate, secure, or available.
15. Website Availability
I Need An Arborist may update, change, suspend, or discontinue any part of the website at any time.
The website may not always be available, error-free, secure, or uninterrupted.
16. Limitation of Liability
To the fullest extent permitted by law, I Need An Arborist is not liable for damages, losses, injuries, disputes, claims, costs, or expenses arising from:
- Use of the website.
- Reliance on listing information.
- Contact with or hiring of any listed professional.
- Work performed or not performed by any listed professional.
- Inaccurate, incomplete, outdated, or misleading information provided by a listed professional.
- Third-party websites, services, or payment providers.
- Website interruptions, errors, or security incidents.
To the fullest extent permitted by law, I Need An Arborist’s total liability for any claim related to the website or these Terms will not exceed the amount paid by the claimant to I Need An Arborist during the twelve months before the claim arose.
17. No Professional Advice
Information on this website is for general informational purposes only. It is not legal, insurance, engineering, arboricultural, forestry, pesticide, safety, or other professional advice.
Users should consult qualified professionals and applicable agencies for advice specific to their situation.
18. Account Termination
I Need An Arborist may suspend or terminate a member account or listing if the member violates these Terms, submits false or misleading information, misuses the website, fails to maintain required account information, or otherwise acts in a way that is inconsistent with the purpose of the website.
After termination, I Need An Arborist may retain certain account, payment, listing, security, or recordkeeping information as needed for legal, business, security, fraud-prevention, tax, dispute, or operational purposes.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, unless applicable law requires otherwise.
Any dispute involving I Need An Arborist should first be raised by contacting info@ineedanarborist.com so the issue can be reviewed.
Nothing in these Terms limits any rights that cannot legally be waived under applicable law.
20. International Use
I Need An Arborist may be accessed by users or members outside the United States.
Laws and consumer rights vary by jurisdiction. Nothing in these Terms is intended to limit rights that cannot legally be waived under applicable law.
If I Need An Arborist actively offers services, listings, or memberships in additional countries or regions, additional regional terms, disclosures, or privacy notices may be added.
21. Changes to These Terms
I Need An Arborist may update these Terms from time to time. The updated version will be posted on this page with a new effective date.
Continued use of the website after changes are posted means you accept the updated Terms.
